Dispute Resolution

If a dispute cannot be resolved through direct communication, you agree that any claim or dispute arising out of or related to these Terms or the Service shall be resolved through binding arbitration conducted by a mutually agreed-upon arbitrator in San Diego County, California, rather than in court, except that either party may bring claims in small claims court if the claims qualify. You waive any right to a jury trial and waive any right to participate in a class action lawsuit or class-wide arbitration.

Note: Arbitration clauses and class action waivers are subject to legal challenges in some jurisdictions and under some circumstances. This provision does not affect rights you may have under applicable consumer protection statutes that cannot be waived by contract. Governing Law and Venue

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

For any dispute not subject to arbitration under the section above, you agree to submit to the personal and exclusive jurisdiction of the state courts located in San Diego County, California, or the United States District Court for the Southern District of California.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms constitute the entire agreement between us regarding the Service and supersede any prior agreements between us.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
